This Privacy Policy explains how Pemly ("Pemly," "we," "us," or "our") collects, uses, shares, and protects information when you use our website, mobile and web applications, and related services (together, the "Service"). By using the Service or joining our waitlist, you agree to the practices described here.

1. Who we are

2. Information we collect

Information you give us

• Waitlist and contact details — the email address you submit to join the waitlist or to contact us.
• Account information — name, email, phone number, company name, role, and password when you or your organization create an account.
• Job and communication content — messages, comments, status updates, photos, files, customer details, and notes that you and your team post in Pemly while working on jobs.
• Support communications — information you provide when you contact us for help or send feedback.

Information we collect automatically

• Usage data — features used, channels viewed, actions taken, and timestamps, so we can operate and improve the Service.
• Device and log data — IP address, browser and device type, operating system, app version, and crash or diagnostic logs.
• Cookies and similar technologies — used to keep you signed in, remember preferences, and understand how the Service is used. You can control cookies through your browser settings.

3. How we use information

We use the information we collect to:

• Provide, operate, secure, and maintain the Service;
• Create and manage accounts and authenticate users;
• Power product features, including the Pemly Assistant, which summarizes job activity, flags risks and delays, and drafts customer updates;
• Send service-related messages, including launch and waitlist updates, account notices, and support responses;
• Understand usage, troubleshoot problems, and improve features and reliability;
• Detect, prevent, and address fraud, abuse, and security incidents; and
• Comply with legal obligations and enforce our Terms of Service.

4. AI features and your content

The Pemly Assistant processes the content in your job channels to generate summaries, surface risks, and draft messages. To make this work, your content may be processed by trusted AI service providers acting on our behalf under contractual confidentiality and data-protection commitments.

• We do not sell your content.
• We do not use your private job content to train publicly available, third-party AI models.
• We may use aggregated and de-identified information (which does not identify you or your customers) to improve and evaluate the Service.

AI-generated output can be inaccurate or incomplete. You are responsible for reviewing AI-drafted content — such as customer updates — before relying on or sending it.

5. How we share information

We share information only as described below. We do not sell your personal information.

• Within your organization — content you post in Pemly is visible to other members of your organization's workspace and channels, according to their access.
• Service providers — vendors who host, support, and operate the Service on our behalf (for example, cloud hosting, analytics, customer support, email delivery, and AI processing), under agreements that limit their use of your information.
• Legal and safety — when we believe disclosure is required by law, regulation, legal process, or to protect the rights, property, or safety of Pemly, our users, or the public.
• Business transfers — in connection with a merger, acquisition, financing, or sale of assets, in which case information may be transferred subject to this policy.
• With your direction — when you ask us to share information or connect a third-party integration.

6. Data retention

We keep personal information for as long as your account is active or as needed to provide the Service, and afterward as required to comply with legal obligations, resolve disputes, and enforce our agreements. When you or your organization delete content or close an account, we delete or de-identify the associated personal information within a commercially reasonable period, except where retention is required by law.

7. Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and regular monitoring. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please keep your account credentials confidential and notify us promptly of any suspected unauthorized access.

8. Your choices and rights

Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. To make a request, contact us at support@pemly.app. We will respond consistent with applicable law and may need to verify your identity first.

• Marketing emails — you can opt out of non-essential emails using the unsubscribe link or by contacting us. We may still send service-related messages.
• Account information — you can review and update most account details directly in the Service.
• California residents — we do not sell or "share" personal information as defined under the California Consumer Privacy Act (CCPA/CPRA), and we will not discriminate against you for exercising your rights.

If your information was provided to us by your employer or an organization using Pemly, please direct certain requests to that organization, which controls the workspace.

9. Children's privacy

The Service is intended for business use by adults and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

10. International users

Pemly is operated in the United States, and information we collect is processed and stored in the United States and other countries where we or our service providers operate. By using the Service, you understand that your information may be transferred to and processed in the United States, which may have different data-protection laws than your country.

11. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated policy.
